These terms govern the OPTEL website. Internet service, installation, equipment and billing are governed by the service provider’s separate order and service terms presented before service begins.
1. Who operates this website
This website is operated by UCC Optel Inc. (“Optel”, “we”, “us” or “our”). OPTEL® is a registered trademark of Telecom Intellectual Property Limited and is used under licence by UCC Optel Inc.
2. Using the website
You may use this website to learn about OPTEL offers, check an address, register interest and contact an authorized local service provider. You agree not to interfere with the website, attempt unauthorized access, submit information about another person without authority, or use automated means that place an unreasonable load on the service.
3. Address checks, planned service and market evaluations
An address result is preliminary and may depend on engineering, line of sight, network capacity, construction, permissions, installation conditions and final verification by the local provider. “Available now” does not itself create a service contract. A planned date is an estimate, not a guaranteed completion or activation date. A market-evaluation page measures possible demand and does not represent that service, a provider, a price or a construction plan presently exists. Registering interest does not require you to purchase service and does not require Optel or another party to build or provide service.
4. Richmond service
In Richmond, Prince Edward Island, the OPTEL-branded offer is offered, contracted, billed and operated by Air Tech Communications Inc., 226 Route 127, Richmond, PE C0B 1Y0, under authorization from UCC Optel Inc. Air Tech provides installation, network service and customer support. Final price, speed, equipment, installation, term and other material conditions will be disclosed before an order is accepted.
5. Information and changes
We work to keep the website accurate, but offers, eligible addresses, prices, timing and availability may change. We may correct errors or update or withdraw an offer before a service contract is formed. Nothing on the website is professional, engineering, financial or legal advice.
6. Communications
If you request availability or offer communications, we may contact you through the channels for which you gave permission. You may withdraw a permission at any time using the instructions in a message or by contacting us. Withdrawal does not affect communications needed to answer a request already in progress or administer an existing service relationship where permitted by law.
7. Intellectual property
The website, its content and OPTEL branding are owned by or licensed to UCC Optel Inc. You may view and make a reasonable personal copy of website information. No trademark licence or right to reproduce, modify, publish or commercially exploit the content is granted.
8. Third-party services and links
Authorized local providers and linked third parties operate independently and may have their own terms and privacy practices. A link does not make Optel responsible for a third-party website or service.
9. Availability and liability
The website is provided on an “as available” basis. To the extent permitted by law, Optel is not liable for indirect, incidental, special or consequential loss arising from use of, or inability to use, the website. Nothing in these terms excludes a right or remedy that cannot lawfully be excluded.
10. Privacy
Our Privacy Policy explains how we handle personal information submitted through this website.
11. Governing law
These terms are governed by the laws of Prince Edward Island and the federal laws of Canada applicable there. Courts in Prince Edward Island have jurisdiction, subject to any consumer right that requires otherwise.
